Wrongful Death: Suspected DUI Driver Kills Beloved Cyclist
Southern Alameda County moves on I-880. The Nimitz Freeway carries commuters, freight from the Port of Oakland, and the daily traffic between Fremont, Newark, Union City, and Hayward, and it is where many of the area’s most serious collisions happen. Add the Dumbarton Bridge and State Route 84 feeding the Peninsula, Niles Canyon Road winding toward Sunol, and the warehouses and tech campuses around Pacific Commons and the Tesla plant, and you have a corner of the East Bay where injuries come from the road and the workplace alike.
Mirador Law represents injured people throughout Fremont and Newark from our Newark office on Balentine Drive. Founded in 1973 and led by former San Francisco public defenders Megan Burns and Emily Dahm, the firm brings more than 40 years of combined experience, close to a hundred jury trials, and two of California’s Top 50 plaintiff verdicts for 2024.
We take serious injury cases across southern Alameda County: car, truck, and motorcycle collisions, bicycle and pedestrian injuries, rideshare crashes, slip and fall and premises cases, dog bites, catastrophic injuries, wrongful death, and abuse cases including nursing home and elder abuse and civil sexual assault claims. Many injured workers in Fremont’s warehouses and manufacturing sites also have a third-party injury claim that goes beyond workers’ compensation, and that is worth checking early.
Injury claims arising in Fremont and Newark are filed in the Superior Court of California, County of Alameda. The Fremont courthouse no longer accepts civil filings, so civil injury cases for the southern county are handled through the Hayward Hall of Justice on Amador Street and the county’s civil division in Oakland. We file and try cases in those venues regularly.
The local injury map is specific. I-880 interchanges at Stevenson, Mowry, and Auto Mall Parkway, the Mission Boulevard and Fremont Boulevard arterials, the Route 84 approach to the Dumbarton, and the parking lots and walkways at Pacific Commons and NewPark Mall in Newark are all places where serious injuries happen. Major trauma from this area is often treated at Washington Hospital in Fremont or transported to the regional trauma center in Oakland.
Because Fremont has a large base of Tesla and other driver-assist vehicles, we handle collisions involving driver-assist technology with care. These cases turn on investigation, vehicle data, and expert analysis, not on assumptions about who or what was in control.
The general deadline to file an injury lawsuit in California is two years from the date of injury under Code of Civil Procedure section 335.1. If a government entity is at fault, you generally have only six months to file an administrative claim under Government Code section 911.2. California’s pure comparative negligence rule means partial fault reduces your recovery but does not bar it.
The following hypothetical examples illustrate how these cases can unfold. They are not based on any specific client and are provided for educational purposes only. A warehouse worker near Pacific Commons is struck by a delivery truck backing up in a shared lot. Workers’ compensation covers part of the loss, but because the truck belonged to an outside company, a separate third-party injury claim can pursue the full range of damages that comp does not reach. Sorting out which claims apply, and against whom, is the work that protects the recovery.
We serve Fremont from our Newark office at 39899 Balentine Drive, Suite 200, Newark, CA 94560. Call (510) 785-8400. We meet clients across southern Alameda County.
In the Superior Court of California, County of Alameda. Civil injury cases for the southern county are handled through the Hayward Hall of Justice and the county’s civil division in Oakland, since the Fremont courthouse no longer takes civil filings.
Not always. If someone other than your employer caused the injury, you may have a third-party injury claim in addition to workers’ compensation. It is worth having a lawyer review both.
Generally two years, and only six months if a government agency is involved. Confirm your deadline early.
