Emily Dahm persuades judge to throw out wiretap evidence in gang case and gets case dismissed
Emily Dahm represented one of nearly two dozen men arrested in Contra Costa County in the “Omega Red” wiretap operation, targeted at bringing down an alleged Norteño gang conspiracy to commit a variety of crimes. Emily took an aggressive approach to the wiretap evidence, forcing the government to turn over the wiretap evidence and transcripts in compliance with state law. When the government failed, Emily successfully moved the court to throw out the wiretap evidence at the preliminary hearing. Then, when the court violated her client’s right to a speedy preliminary hearing, Emily filed multiple motions to get her client’s case dismissed.
